7. SHIPPING AND DELIVERY
7.1. ORDERS WILL BE SHIPPED TO THE SHIPPING ADDRESS PROVIDED BY THE CUSTOMER AT THE TIME OF SUBMITTING THE ORDER. DELIVERY DATE IS APPROXIMATE AND NON-BINDING FOR THE MISLEDS.
7.2. DELIVERY IS AVAILABLE ONLY FOR THE COUNTRIES LISTED BELOW. HOWEVER, IN CASE DELIVERY TO ONE OF THE LISTED COUNTRIES SHOULD NOT BE AVAILABLE, THE CUSTOMER RESIDING IN THE AFFECTED COUNTRY WILL NOT BE ABLE TO PURCHASE THE PRODUCT AND THE MISLEDS SHALL NOT BE HELD LIABLE.

IN ORDER TO COMPLETE DELIVERY, THE U.S. BUREAU OF CONSUMER PROTECTION MAY REQUIRE THE SOCIAL SECURITY NUMBER – SSN.

APPLICABLE EXCISE DUTIES AND IMPORT TAXES ARE AT CUSTOMER’S EXPENSE.THE APPLICABLE AMOUNT SHALL BE PAID TO THE CARRIER AS DESCRIBED BY THE CARRIER.
7.4. IT IS THE CUSTOMER'S RESPONSIBILITY TO CHECK THE QUANTITY AND CONDITIONS OF THE GOODS UPON DELIVERY. IN CASE GOODS ARE DAMAGED OR DO NOT MATCH THE ORDERED QUANTITY, CUSTOMER SHALL IMMEDIATELY NOTIFY THE CARRIER AND SIGN THE DELIVERY NOTE SUBJECT TO CHECKS; CUSTOMER SHALL ALSO NOTIFY THE MISLEDS AT
ORDERS@THEMISLEDS.COM WITHIN 3 DAYS OF THE DELIVERY DATE.
IN THIS CASE, AGAINST VERIFICATION, THE MISLEDS WILL REPLACE THE MISSING OR DAMAGED GOODS AS PER THE CUSTOMER’S ORDER.
8. PARCEL TRACKING
8.1. ONCE THE ORDER REACHES THE CARRIER, THE MISLEDS WILL SEND THE CUSTOMER A NOTIFICATION VIA E-MAIL WITH THE ORDER WAYBILL NUMBER (AWB).
IN ORDER TO TRACK THE SHIPPING STATUS, CUSTOMER CAN VISIT THE COURIER WEBSITE AND TYPE IN THE DEDICATED SEARCH AREA THE AWB NUMBER STATED IN THE E-MAIL.
9. FAILURE TO DELIVER
9.1. BY REGISTERING AN ORDER, CUSTOMER ENGAGES IN A COMMERCIAL RELATIONSHIP WITH THE MISLEDS AND COMMITS TO ACCEPT THE PARCEL DELIVERY RELATED TO THE ORDER MADE. WHERE A PARCEL IS NOT DELIVERED TO THE CUSTOMER’S ADDRESS FOR REASONS RELATED TO THE CUSTOMER’S NON-COOPERATION (INCOMPLETE/INCORRECT PHONE NUMBER, RECIPIENT NOT AVAILABLE) OR WHERE THE CUSTOMER REFUSES THE DELIVERY, PARCEL WILL BE RESENT TO THE MISLEDS (THE SENDER) IN ITALY AT CUSTOMER’S EXPENSE. COSTS CHARGED TO THE CUSTOMER INCLUDE SHIPPING FEES AND ANY CUSTOMS FEE; THESE COSTS WILL BE WITHHELD FROM THE AMOUNT DUE TO THE CUSTOMER.
10. RIGHT OF WITHDRAWAL
10.1. CUSTOMER HAS THE RIGHT TO TERMINATE THE AGREEMENT CONCLUDED WITH THE SELLER WITHOUT INCURRING IN ANY PENALTY AND WITHOUT SPECIFYING THE REASON, WITHIN FOURTEEN (14) DAYS AFTER RECEIVING THE PRODUCTS PURCHASED.
10.2 IF YOU WISH TO EXERCISE THE RIGHT OF WITHDRAWAL YOU CAN DO SO WITHIN 14 DAYS OF RECEIPT OF THE GOODS THROUGH THE FOLLOWING PROCEDURE: COMMUNICATE THAT YOU INTEND TO MAKE THE RETURN VIA E-MAIL AT ORDERS@THEMISLEDS.COM SPECIFYING YOUR ORDER NUMBER AND THE ITEM/ITEMS YOU INTEND TO RETURN;
10.3. CUSTOMER SHALL RETURN THE PRODUCTS TO THE SELLER VIA THE CARRIER WITHIN SEVEN (7) DAYS AFTER NOTIFYING THE SELLER OF THE DECISION TO TERMINATE THE AGREEMENT.
10.4. PRODUCTS MUST BE RETURNED UNDAMAGED, UNUSED IN THEIR ORIGINAL PACKAGING AND WITH ALL TAGS AND SHIPPED WITHIN 14 BUSINESS DAYS OF RECEIPT TO:

EXCISE DUTIES, IF ANY, ARE AT CUSTOMER’S EXPENSE AND WILL BE DEDUCTED FROM THE REFUND DUE.
THE COST OF RETURNING THE PRODUCT/S TO OUR WAREHOUSE IS THE RESPONSIBILITY OF THE CUSTOMER WHO IS FREE TO CHOOSE THE CARRIER HE/SHE PREFERS FOR THE SHIPMENT. ONLY IN CASE OF PRODUCT DEFECTS ATTRIBUTABLE TO THE MISLEDS, THE COMPANY RESERVES THE RIGHT TO CONSIDER TAKING CHARGE OF THE COST.
10.5. RIGHT OF WITHDRAWAL SHALL BE CONSIDERED DULY EXERCISED WHEN TERMS HEREBY STATED IN ARTICLE 7 ARE COMPLIED WITH AND WHEN THE FOLLOWING CONDITIONS ARE FULLY MET:
- CUSTOMER HAS FILLED IN THE ONLINE RETURN FORM BY LOGGING IN THE RESERVED AREA WITHIN 14 DAYS AFTER RECEIVING THE ORDER.
- PRODUCTS HAVE NOT BEEN WORN, WASHED OR USED;
- BRAND TAG MUST BE ATTACHED, AS IT IS AN INTEGRAL PART OF THE GOODS;
- PRODUCTS MUST BE RETURNED WITH THE ORIGINAL PACKAGE, WHICH MUST NOT BE ALTERED OR DAMAGED, WITH ORIGINAL TAGS, PACKAGING AND OTHER ACCESSORIES (DUST BAG, GARMENT BAG, ETC.) RECEIVED IN THE ORIGINAL ORDER; ORIGINAL PACKAGES MUST NOT BE USED AS PACKAGING BOXES FOR THE SHIPMENT.
- PRODUCTS MUST BE RETURNED TO THE FORWARDER WITHIN FOURTEEN (14) DAYS AFTER NOTIFYING THE SELLER THE DECISION TO TERMINATE THE AGREEMENT;
- PRODUCTS MUST NOT BE DAMAGED.
10.6. IF THE RIGHT OF WITHDRAWAL IS DULY EXERCISED IN ACCORDANCE WITH THE TERMS AND CONDITIONS STATED IN ARTICLE 7, SELLER SHALL REFUND ANY AMOUNT ALREADY PAID BY THE CUSTOMER FOR THE PRODUCTS’ PURCHASE, IN ACCORDANCE WITH THE RELEVANT TERMS AND CONDITIONS PROVIDED.
10.7. AMOUNTS SHALL BE REFUNDED TO THE CUSTOMER AS SOON AS POSSIBLE AND IN ANY CASE WITHIN FOURTEEN (14) DAYS AFTER THE SELLER RECEIVES RETURNED GOODS AND AFTER CHECKING THE ABOVE-MENTIONED TERMS AND CONDITIONS HAVE BEEN COMPLIED TO.
10.8. IF TERMS AND CONDITIONS FOR WITHDRAWAL AS OF POINTS A), B), C), D), E) AND F) OF ARTICLE 10 ARE NOT COMPLIED WITH, THE CUSTOMER WILL NOT BE ENTITLED TO THE REFUND OF ANY AMOUNT ALREADY PAID TO THE SELLER. WITHIN 14 DAYS AFTER SENDING THE E-MAIL NOTIFYING THE CUSTOMER THAT REFUND REQUEST HAS BEEN DECLINED, CUSTOMER MAY CHOOSE TO HAVE BACK HIS/HER PRODUCTS, AT HIS/HER OWN EXPENSE AND IN THE SAME CONDITIONS AS ITEMS WERE RETURNED, BY NOTIFYING THE SELLER VIA THE PROCEDURE THAT WILL BE COMMUNICATED TO THE CUSTOMER. OTHERWISE, THE SELLER MAY KEEP THE PRODUCTS IN ADDITION TO THE AMOUNTS THE CUSTOMER ALREADY PAID FOR THE PURCHASE.
10.9. SELLER SHALL PROVIDE THE REFUND WITH THE SAME PAYMENT METHOD USED TO PURCHASE RETURNED PRODUCTS.
10.10. IF THE PRODUCTS’ RECEIVER STATED IN THE ORDER FORM IS NOT THE SAME PERSON WHO PAID FOR THE PURCHASE, IN CASE OF EXERCISE OF THE RIGHT OF WITHDRAWAL, THE SELLER WILL REFUND THE PERSON WHO MADE THE PAYMENT.
